These general terms and conditions of use, which may be amended periodically, apply to all users of the booking platform. By accessing our booking platform, searching on it, or making a reservation, you declare that you understand the scope of and accept our general terms and conditions of use.

These pages, their content and infrastructure, as well as the booking platform for these pages, are owned, operated and provided by elloha.com and are made available to you solely for personal, non-commercial use, subject to the terms and conditions of use set out below.

1. Our Service

Through the website through which you accessed our booking platform, Elloha.com and its licensees (tourism service providers or affiliated sites distributing the booking platform) provide an online booking platform allowing the reservation of tourism and leisure products and services. These services and products are offered by the operators of these own services or their agents. Under no circumstances will Elloha.com be considered the producer or operator of said tourism and leisure services or products. By making a reservation through Elloha.com, you enter into a direct contractual relationship with the establishment concerned by your reservation. Elloha.com acts solely as an intermediary between you and the establishment concerned: we transmit the details of your reservation to them and send you a confirmation email for and on their behalf.

When providing our services, the information we provide is based on information recorded by the establishments under their own responsibility. Establishments are therefore given access to our platform (extranet), through which they are solely responsible for updating all their rates, availability and other information displayed on the booking engine. Although we strive to provide a quality service, we cannot verify or guarantee the accuracy, precision or completeness of the information, and we cannot be held responsible for any errors (manifest errors or typographical errors), any interruption of service (due to a technical failure, whether temporary and/or partial, breakdown, repair, update, improvement or maintenance of our website or otherwise), any inaccurate, misleading or erroneous information, or any lack of information. Each establishment remains responsible at all times for the accuracy, completeness, and correctness of the (descriptive) information about it displayed through our booking platform, including its rates and availability. Our booking platform does not constitute, and should not be considered, any form of recommendation or endorsement of the quality, level of service, or ranking of each establishment offered to visitors.

Our services are available for private, non-commercial use only. You may not resell, use, copy, monitor (e.g., through spidering or screen scraping), display, download, reproduce, or deep-link to any content or information, software, and/or products or services available on our website for any commercial or competitive purpose or activity.

2. Confidentiality of information and cookies

Elloha.com respects your personal data, which is transmitted to the operator of the service you book when your booking is confirmed.

3. Free

Our service is free. We will not charge you for our service and we will not add any additional (booking) fees to the rate.

4. Bank card and bank transfer

Properties bookable through Elloha.com are paid directly (in full or in part, depending on the property's payment terms detailed below) during the booking process using secure online payment methods. Payment is made securely from your credit/debit card to the property via a third-party payment processor.

For certain non-refundable rates and special offers, please note that the property reserves the right to request advance payment by credit card and therefore a pre-authorization of your bank card or a charge of a certain amount (sometimes without the possibility of refund) from this same card at the time of booking. Before making your reservation, please carefully read the description of the services and products offered to be aware of such conditions.

5. Cancellation conditions

By making a reservation at a property, you acknowledge that you have read and accepted the property's cancellation and no-show policies, as well as any additional terms and conditions of the property that may apply to your reservation or during your stay, including for services rendered and/or products offered by the property. The general cancellation and no-show policies specific to each property are indicated below; They are also reminded during the booking process and in the booking confirmation email. Please note that some rates or special offers do not allow cancellation or modification of the booking. You are therefore invited to read the conditions of each establishment before making your booking. Reservations requiring a deposit or prepayment (in whole or in part) may be cancelled (without prior warning or notice of default) if the requested amount(s) (or balance) are not received in full by the agreed payment date, according to the payment conditions of the relevant establishment and booking. You will be considered responsible for any late payment, any incorrect bank, credit or debit card details, any invalid credit/debit card or insufficient funds and will not be entitled to any refund of a (non-refundable) prepayment unless otherwise stated in the (pre)payment and cancellation conditions of the establishment.

If you wish to modify or cancel your reservation, please refer to your confirmation email and follow the instructions therein. Please note that any cancellation may incur fees, in accordance with the establishments' cancellation, (pre)payment, and no-show policies, and that (pre)paid amounts may not be refunded. We advise you to read these cancellation, (pre)payment, and no-show policies carefully before making your reservation and to make any upcoming payments within the agreed timeframe for the reservation.

6. Future correspondence

By making a reservation, you agree to receive (i) an email that we may send you before your arrival date at the property, which will contain information about your destination and offers relevant to your stay (including offers from our partners, if you have agreed to receive them), and (ii) an email that we may send you after the end of your stay at the property, which will invite you to complete our guest feedback questionnaire.

7. Disclaimer

Subject to the limitations set forth in these Terms of Service and permitted by law, we may only be held liable if you have suffered, paid, or incurred direct damages that can be attributed to a failure to perform our obligations under our Services. These damages may amount to the cumulative amount of the total cost of your booking, as indicated in the confirmation email, whether for a single event or a series of related events. However, and to the extent permitted by law, neither we nor our directors, officers, employees, representatives, subsidiaries, affiliates, distributors, (distribution) partners, sublicensees, agents or other persons involved in creating, sponsoring, promoting or making available the platform and its contents, shall be liable for (i) any punitive, special, indirect or consequential losses or damages, loss of production, loss of profit, loss of revenue, loss of business opportunity, loss of or damage to brand or reputation, or loss of the right to compensation; (ii) any inaccuracy related to the (descriptive) information of the property (including its rates, availability and ranking) made available on our booking platform; (iii) any services provided or products offered by the establishment or other partners; (iv) any damages, losses and costs (punitive, special, indirect or consequential) suffered, incurred or paid by you, attributable to, arising out of or related to the use of our booking platform, the impossibility of its use or its slowdown of operation; or (v) any personal injury, death, property damage or other damages, losses or costs (whether direct, indirect, special, consequential or punitive) suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, willful misconduct, omissions, breach of contract, misrepresentations, tort or strict liability attributable in whole or in part to the establishment (including its employees, management, officers, agents, representatives or affiliates) whose products and services are (directly or indirectly) offered or promoted on or through our booking platform, including any cancellation (even partial), overbooking, strike, force majeure or other event beyond our control.

You acknowledge and agree that the property with which you make your reservation is at all times responsible for the collection, withholding, remittance, and payment of applicable taxes due on the total rate amount to the appropriate tax authorities. Elloha.com is neither responsible nor liable for the remittance, collection, withholding or payment of any applicable taxes due on the tariff to the relevant financial authorities.

8. Intellectual Property Rights

Unless otherwise stated, the software required for our services or made available on our booking platform and used by the latter, as well as the intellectual property rights (including copyright) of the contents, information and materials on our website, are the exclusive property of Elloha SAS, its suppliers or its service providers.

Elloha.com remains the sole owner of all rights, titles, and interests (relating to all intellectual property rights) in and to the booking platform (including its layout and infrastructure) on which the service is available. Therefore, you are not permitted to copy, link (hyperlink or deeplink) to our content, publish, promote, market, integrate, or otherwise use our content or branding without our express written permission. To the extent that you use (part or all of) our content or hold intellectual property rights in our booking platform, our content, you must assign and transfer all such rights to Elloha.com. Any unlawful use or action referred to above will constitute a material breach of our intellectual property rights (including copyright and database rights).

9. DISPUTE - CONSUMER MEDIATION

In accordance with the law, these general terms of use and the provision of our services are subject to and governed by French law. Any dispute arising from these general terms of use and our services must be brought exclusively to the attention of the competent authorities in Paris, France.

If any provision of these Terms of Use is or becomes invalid, unenforceable or unenforceable, you will remain bound by all other provisions set forth in these Terms. If so, the invalid provisions shall be enforced to the fullest extent permitted by law and you agree to comply with any provisions that would have the same effect as the invalid, unenforceable or non-binding terms of these Terms of Use.
