These terms and conditions of use, which may be amended periodically, apply to all users of the booking platform. By accessing, searching, or making a booking on our booking platform, you acknowledge that you understand and accept these terms and conditions of use.

These pages, their content and infrastructure, as well as the booking platform of these pages, belong to elloha.com, are managed and provided by Elloha.com and are made available to you solely for personal and non-commercial use which remains subject to the general terms of use established below.

1. Our Service

Through the website you accessed our booking platform, Elloha.com and its licensees (tourism providers or affiliated sites hosting the booking platform) provide an online booking platform for booking tourism and leisure products and services. These services and products are offered by the operators of these services or their agents. Under no circumstances will Elloha.com be considered the producer or operator of said tourism and leisure services or products. By making a booking through Elloha.com, you enter into a direct contractual relationship with the establishment concerned by your booking. Elloha.com acts solely as an intermediary between you and the establishment concerned: we transmit your booking details to them and send you a confirmation email on their behalf.

When providing our services, the information we communicate is based on information recorded by the establishments under their own responsibility. The establishments are therefore granted access to our platform (extranet), through which they bear full responsibility for updating all their rates, availability, and other information displayed on the booking engine. While we strive to provide a quality service, we cannot verify or guarantee the accuracy, precision, or completeness of the information, and we cannot be held liable for any errors (obvious mistakes or typographical errors), any service interruptions (due to technical failures, whether temporary and/or partial, outages, repairs, updates, improvements, or maintenance of our website or otherwise), any inaccurate, misleading, or erroneous information, or any lack of information. Each establishment remains responsible at all times for the accuracy, completeness, and correctness of the (descriptive) information concerning it and displayed through our booking platform, including its rates and availability. Our booking platform does not constitute and should not be considered as any form of recommendation or endorsement of the quality, level of service or rating of each establishment offered to visitors.

Our services are available for private, non-commercial use only. Therefore, you may not resell, use, copy, monitor (e.g., via a web crawler or screen scraping), display, download, reproduce, or deep-link to any content, information, software, and/or products or services available on our website for any commercial or competitive purpose.

2. Information confidentiality and cookies

Elloha.com respects your personal data which is transmitted to the operator of the service you book at the time of confirmation of your booking.

3. Free of charge

Our service is free. We will not charge you for our service and we will not add any additional (booking) fees to the price.

4. Bank card and bank transfer

Accommodations bookable through Elloha.com are paid directly (in full or in part, depending on the accommodation's payment terms outlined below) during the booking process using secure online payment methods. Payment is securely transferred from your credit/debit card to the accommodation via a third-party payment processor.

For certain non-refundable rates and special offers, please note that the establishment reserves the right to request advance payment by credit card and therefore pre-authorize your card or charge a certain amount (sometimes without the possibility of a refund) to that same card at the time of booking. Before making your reservation, please carefully review the description of the services and products offered to understand these conditions.

5. Cancellation conditions

By making a reservation at a property, you acknowledge that you have read and accepted the property's cancellation and no-show policy, as well as any additional terms and conditions that may apply to your reservation or during your stay, including those related to services and/or products offered by the property. The specific cancellation and no-show policies for each property are detailed below; they are also reiterated during the booking process and in the booking confirmation email. Please note that some rates or special offers do not allow cancellation or modification of the reservation. Therefore, you are advised to review the specific terms and conditions of each property before making your reservation. Reservations requiring a deposit or prepayment (full or partial) may be cancelled (without prior notice or default notification) if the required amount(s) (or balance) are not received in full by the agreed payment date, in accordance with the establishment's and the relevant reservation's payment terms. You will be held responsible for any late payments, incorrect bank, credit, or debit card details, invalid credit/debit cards, or insufficient funds, and will not be entitled to any refund of a prepayment (which is non-refundable) unless otherwise stated in the establishment's (pre)payment and cancellation policy.

If you wish to modify or cancel your reservation, please refer to your confirmation email and follow the instructions provided. Please note that any cancellation may incur charges, in accordance with the establishment's cancellation, (pre)payment, and no-show policies, and that (pre)paid amounts may not be refundable. We advise you to carefully read these cancellation, (pre)payment and no-show conditions before making your reservation and to make any future payments within the agreed timeframe for said reservation.

6. Future correspondence

By making a reservation, you agree to receive (i) an email that we may send you before your arrival date at the property, which will contain information about your destination and offers relevant to your stay (including offers from our partners, if you have agreed to receive them), and (ii) an email that we may send you after the end of your stay at the property, which will invite you to complete our customer feedback questionnaire.

7. Disclaimer of liability

Subject to the limitations set forth in these terms and conditions and permitted by law, we can only be held liable if you have suffered, paid for, or incurred direct damages attributable to a breach of our obligations under our services. Such damages may amount to the total cost of your booking, as stated in the confirmation email, whether for a single event or a series of related events. However, and to the extent permitted by law, neither we nor our officers, directors, employees, representatives, subsidiaries, affiliates, distributors, (distribution) partners, sublicensees, agents, or any other persons involved in the creation, sponsorship, promotion, or provision of the platform and its content shall be liable for (i) any punitive, special, indirect, or consequential losses or damages, loss of production, loss of profit, loss of revenue, loss of business opportunity, loss of or damage to brand or reputation, or loss of the right to compensation; (ii) any inaccuracies related to the (descriptive) information of the establishment (including its rates, availability, and rating) made available on our booking platform; (iii) any services provided or products offered by the establishment or other partners; (iv) all damages, losses and costs (punitive, special, indirect or consequential) suffered, incurred or paid by you, attributable to, arising out of or related to the use of our booking platform, the inability to use it or its slow operation; or (v) any personal injury, death, property damage or other damages, losses or costs (direct, indirect, special, consequential or punitive) suffered, incurred or paid by you, whether due to (lawful) acts, errors, omissions, (gross) negligence, willful misconduct, omissions, breach of contract, misrepresentation of facts, tort or strict liability attributable wholly or partly to the establishment (including its employees, management, officers, agents, representatives or affiliates) whose products and services are (directly or indirectly) offered or promoted on or through our booking platform, including any cancellation (even partial), overbooking, strike, force majeure or other event beyond our control.

You acknowledge and agree that the establishment with which you make your reservation is at all times responsible for the collection, withholding, remittance, and payment of applicable taxes due on the total rate amount to the relevant financial authorities. Elloha.com is neither responsible nor liable for the payment, collection, withholding or remittance of any applicable taxes due on the tariff to the relevant financial authorities.

8. Intellectual Property Rights

Unless otherwise stated, the software required for our services or made available on our booking platform and used by the latter, as well as the intellectual property rights (including copyrights) of the content, information and materials of our website, are the exclusive property of Elloha SAS, its suppliers or its service providers.

Elloha.com remains the sole owner of all rights, title, and interest (including all intellectual property rights) in the booking platform (including its presentation and infrastructure) on which the service is available. Therefore, you are not authorized to copy, link (hyperlinked or deep) to our content, publish, promote, market, integrate, or otherwise use our content or trademark without our express written permission. To the extent that you use (part or all) our content or hold intellectual property rights in our booking platform or content, you must assign and transfer all such rights to Elloha.com. Any illegal use or action as described above will constitute a substantial infringement of our intellectual property rights (including copyright and database rights).

9. DISPUTE - CONSUMER MEDIATION

In accordance with the law, these terms and conditions of use and the provision of our services are subject to and governed by French law. Any dispute arising from these terms and conditions of use and our services must be brought exclusively before the competent authorities in Paris, France.

If any provision of these terms and conditions is or becomes invalid, unenforceable or non-binding, you remain bound by all other provisions set forth in these terms. If that is the case, the invalid provisions shall be applied to the fullest extent permitted by law and you agree to comply with provisions that would have the same effect as the invalid, unenforceable or unbinding terms of these terms and conditions.

In the event of a dispute between the Client and the company, they will endeavor to resolve it amicably (the Client will send a written complaint to the Seller). If no amicable agreement is reached, or if the company fails to respond within a reasonable period of one month, the Client, as a consumer within the meaning of Article L.133-4 of the French Consumer Code, has the option of contacting, free of charge, the competent mediator listed by the Consumer Mediation Evaluation and Control Commission pursuant to Article L.615-1 of the French Consumer Code, if a disagreement persists. The mediator is listed by the Commission for the Evaluation and Control of Consumer Mediation, pursuant to Article L.615-1 of the French Consumer Code. 10. Arrival and departure times (Check-in / Check-out)

Rooms [or accommodations / rentals] are available from 5:00 PM on the day of arrival and must be vacated by 10:00 AM on the day of departure.

• Late Check-out: Any departure after 10:00 is subject to prior request to reception and remains dependent on the availability of the establishment.
• Additional charge: If a late departure is agreed upon, a flat-rate surcharge of €20 per additional hour started will be charged to the client.
• Unauthorized departure: Without prior agreement, remaining on the premises after 10:00 AM will result in an automatic charge for an additional night at the current public rate. This charge does not, however, authorize the client to occupy the accommodation for an additional night if it is booked.

11. Electricity consumption and heating

For stays between September 15th and April 30th, electric heating is not included in unlimited quantities in the rental price in order to control energy consumption.

• Overage charge: A daily consumption of [7 kWh] is included in the nightly rate. Any excess consumption recorded between arrival and departure will be charged at the end of your stay based on the current rate (20 cents per kWh).

A joint meter reading is taken during the entry and exit inventory.
